We offer client from Bulgaria following service for debt collection abroad:
1. In case the debtor does not dispute the claim, we initiate a procedure according to REGULATION (EC) No 1896/2006 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 12 December 2006 creating a European order for payment procedure. After acquiring of title of execution we hand the case over to our partner law office in the respective country for conduct of foreclosure.
2. In case that the debtor disputes the claim and amount of the debt does not exceed 2 000 EUR, we initiate a procedure for acquiring of a title of exexution according to Regulation (EC) No 861/2007 of the European Parliament and of the Council of 11 July 2007 establishing a European Small Claims Procedure. After acquiring of title of execution we hand the case over to our partner law office in the respective country for conduct of foreclosure.
3. In case that debtor disputes the claim and the bulgarian court is competent to resolve the case, we file a lawsuit in Bulgaria. Afer acquiring of title of execution and certificate of execution we hand the case over to a parner law office in the respective country for conduct of foreclosure according to REGULATION (EU) No 1215/2012 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
4. In case that the debtor disputes the claim and the foreign court is competent to resolve the case, we hand the case over to a partner law office in the respective country which files a lawsuit, obtains the title of execution and conducts the foreclosure. We follow tha case and inform the client about the progress.
